Scope
These terms apply to the Anysetter service provided by superview llc to businesses. Anysetter is not offered to consumers. The individual offer agreed in writing takes precedence over these terms.
The service
Anysetter writes to the customer's leads over WhatsApp on the customer's behalf, answers their questions, qualifies them and books appointments. Setup of the WhatsApp connection, message templates and the setter is carried out together with the customer.
Customer responsibilities
The customer is responsible for having a legal basis, in particular consent, for contacting each lead, and for its own WhatsApp Business, calendar and CRM accounts. The customer provides accurate information about its offer and does not ask the setter to make statements that are misleading or unlawful.
Fees
Fees are set out in the individual offer and are billed monthly. Message fees charged by Meta for WhatsApp are paid by the customer directly to Meta through its own account. We give no guarantee of a particular number of appointments or of sales results.
WhatsApp account and number
The WhatsApp Business account and the number belong to the customer and are subject to Meta's terms. Meta may restrict or block numbers, templates or accounts, for example after complaints from recipients. We follow Meta's rules and help the customer do the same, but we are not liable for Meta's decisions.
Term and termination
The contract runs until terminated. Either party may terminate it with 14 days' notice. On termination, we hand the customer its lead data on request; we delete it afterwards in accordance with the data processing agreement.
Liability
We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.
Data protection
Where we process personal data on the customer's behalf, the data processing agreement applies. Our privacy policy describes how we process data as a controller.
Governing law
These terms are governed by the laws of the State of Wyoming, USA.
